1. Who sells and what these terms cover
These terms of sale apply to every purchase of a course on https://learn.ouerfelli-raed.com (the "Platform"). The seller is IMAGINARIA CODE LAB, B 05, Résidence Abraj, Cité Ennakhil, 2045 La Aouina, Tunis, Tunisie, tax ID 1863345/E/A/M/000, email contact@ouerfelli-raed.com (see the Legal notice).
You accept these terms by ticking the consent box before you confirm an order. We record the date and the version you accepted on your order. A new version of these terms applies only to orders placed after it is published.
2. The courses
The Platform sells online courses made of videos and reading lessons, which are digital content supplied without a physical medium. Each course page describes the content, the lessons and their duration. Videos may be recorded in one language for all students; the interface and texts are available in French, English and Arabic.
3. Prices
Prices are in Tunisian dinars (TND), all taxes included (TTC): VAT at 19% and the stamp duty (droit de timbre) are included. If a course page shows a price in another currency, that price is also all taxes included. The price shown is the total amount you owe us. The price that applies is the one shown when your order is created; it is copied onto your order. Fees charged by your own bank or by intermediary banks for the transfer are at your expense.
4. Ordering
- Sign in with your email address.
- On the course page, tick the consent box and click "Get access".
- Your order is created with a unique reference. The order page and a confirmation email give you the amount, the reference and our bank details.
The contract is concluded when your order is created. You can see your order at any time from your dashboard.
5. Payment
Payment is made by bank transfer only, for now. Put the order reference in the transfer label so we can match your payment. You can upload proof of the transfer on your order page, which helps us confirm it faster.
We check incoming transfers by hand. Your payment is confirmed when the funds reach our account, usually within one business day after they arrive. We may cancel an order that is still unpaid 30 days after it was created; you will receive an email.
When we confirm your payment, we issue an invoice in French, available from your order page. If you buy for a company, enter its name and tax ID on the order page before paying so they appear on the invoice.
6. Access to the course
Access starts when we confirm your payment. You receive an email and the course appears in your dashboard.
Access is personal: it is for you only and must not be shared (see the Terms of use).
Access is granted for life unless the course page states another duration. "For life" means for as long as the course is offered on the Platform. If we stop offering a course you bought, we will tell you by email at least 30 days before access ends.
We may update a course to keep it accurate and current. Updates never remove the main content that was described when you bought it.
7. Right of withdrawal
Before access starts. You can cancel your order at any time before access starts, for any reason. Write to contact@ouerfelli-raed.com with your order reference. If you have already paid, we refund the full amount within 14 days by bank transfer to the account you paid from.
Consumers in the European Union, the European Economic Area and the United Kingdom. You normally have 14 days from the conclusion of the contract to withdraw. For digital content supplied without a physical medium, this right ends once supply has started with your prior express consent and your acknowledgement that you lose the right (Article 16(m) of Directive 2011/83/EU). By ticking the consent box you expressly ask for access to start as soon as your payment is confirmed, which may be before the 14 days end, and you acknowledge that you lose your right of withdrawal once access starts. We confirm this consent in the order confirmation email.
Consumers in Tunisia. You benefit from the right of withdrawal set by Law No. 2000-83 of 9 August 2000 on electronic exchanges and commerce, within the limits and exceptions of that law, including when the service is provided, at your request, before the withdrawal period ends.
Consumers elsewhere. The mandatory consumer protection rules of your country of residence apply.
How to withdraw. Send a clear statement to contact@ouerfelli-raed.com, for example: "I hereby give notice that I withdraw from my contract for the following course: [course], ordered on [date], order reference [reference], name [name], email [email]."
8. Refunds and conformity
If a course does not match its description, or a technical problem on our side prevents you from using it and we cannot fix it within a reasonable time, write to contact@ouerfelli-raed.com. You can then ask for a price reduction or a refund, as provided by the law that applies to you. Refunds are paid by bank transfer within 14 days after we agree on them.
Except in the cases above and where the law requires it, a course is not refunded once access has started.
9. Liability
The courses are educational content. We do not guarantee any particular result, income or job outcome from following them.
We make reasonable efforts to keep the Platform available, but it may be interrupted for maintenance or by events beyond our control.
To the extent allowed by law, we are not liable for indirect losses such as lost profits or lost data, and our total liability for a course is limited to the price you paid for it. Nothing in these terms limits liability that cannot be limited by law, in particular for intentional misconduct or gross negligence, or your mandatory rights as a consumer.
10. Personal data
We process your personal data as described in the Privacy policy.
11. Governing law and disputes
These terms are governed by Tunisian law. If you are a consumer living in another country, you also keep the protection of the mandatory provisions of the law of your country of residence.
Please contact us first at contact@ouerfelli-raed.com: most problems are solved quickly by email. If no amicable solution is found, the Tunisian courts have jurisdiction, unless consumer law gives you the right to bring the case before the courts of your country of residence.
